6TH ARANZADI FORUM ON SPORTS 2012/2013

The Foundation has kept up its collaboration with Aranzadi-Thomson in order to hold the 6th ARANZADI FORUM ON SPORTS, a meeting for professionals based on practice and discussion and devoted to constantly updating the knowledge of all those professionals who carry out their activities in the field of Sports Law.

The objective of this Sports Law Forum is to keep updated, in a systematic and rigorous manner, the knowledge necessary in order to work with security and guarantees in the different areas of the ever-changing field of Sports Law.

The Forum was held at the headquarters of Liga de Futbol Profesional and it consisted of eight sessions that took place from September 2012 to June 2013.

FORUM ON LAW AND PROFESSIONAL SPORT, organised by FIDE (Foundation for Research in Law and Business) on the 26th of February 2012 in Madrid

The Foundation ratified the collaboration agreement signed with FIDE (Foundation for Research in Law and Business) last year to hold Forums focusing on law and professional sport.

The first of these sessions was held on the 26th of February, entitled “THE NEW MANAGEMENT MODEL OF SPORTS SPONSORSHIP”, and it focused on the company-consumer relationship through sports sponsorship; personal brands and digital identity: differences between the management of sponsorship in traditional media and the internet; protection and promotion: synergies and conflicts between sportspeople and companies.

2nd EUROPEAN FORUM ON THE SOCIAL RESPONSIBILITY OF PROFESSIONAL FOOTBALL, organised by the EPFL on the 27th of November 2012 in Lisbon (Portugal)

2nd EUROPEAN FORUM ON THE SOCIAL RESPONSIBILITY OF PROFESSIONAL FOOTBALL

The Association of European Professional Football Leagues organised on the 27th of November in Lisbon the 2nd FORUM ON THE SOCIAL RESPONSIBILITY OF PROFESSIONAL FOOTBALL, with the participation of numerous European Leagues' Foundations and football clubs. Participants shared their experiences and points of view as well as promoted new ways for the development and cooperation in the field of European corporate social responsibility.

It was considered to be a top-level social responsibility event in the world of football and thus it had the active participation of our Foundation, with a very interesting talk given by our Chairman on the social activities of the Spanish League Foundation since it was created 20 years ago.

Framework Collaboration Agreement between the University CEU San Pablo and the Foundation Fundacion del Futbol Profesional

The Foundation signed in September a Collaboration Agreement with the University CEU San Pablo in order to run a degree on Sports Law at the School of Law - under the direction of lecturer D. Alberto Palomar. In the future, a specific agreement will be signed to specify the conditions, goals and the resources needed for the development of this collaboration, as well as other agreements that may arise. The agreement has validity for one year, tacitly renewed in similar periods.

LOYALTY-BUILDING OF MINORS PLAYING FOR YOUTH SQUADS, a Day organised by Fundacion del Futbol Profesional in collaboration with Gómez Acebo & Pombo on the 8th of May 2013

LOYALTY-BUILDING OF MINORS PLAYING FOR YOUTH SQUADS

Fundacion del Futbol Profesional held a legal breakfast on the 8th of May at the LFP's headquarters in collaboration with legal firm Gómez Acebo & Pombo during which the "Baena Case" ruling, regarding the pre-contracts made by the parents of minor footballers, was analysed.

The event, presented by the recently appointed LFP chairman Javier Tebas Medrano, dealt with issues such as: ways to evaluate training costs, mechanisms to obtain court authorisations in those cases or how to demand non-contractual liability from the destination clubs, amongst many other issues that were analysed and discussed during the two-hour meeting.

This event was attended by most Clubs and sports public limited companies that are members of the LFP, by representatives of different institutions and Public Administrations, as well as by the experts in this topic from Gómez-Acebo & Pombo, Antonio V. Sempere Navarro, Ángel Carrasco Perera and Manuel J. Martín Domínguez. It also had the participation of the CEO of Villareal CF, SAD, Fernando Roig Negueroles and the legal advisor of Liga Nacional de Fútbol Profesional, Miguel M. García Caba.

Seminar on the REFORM OF THE LEGAL SYSTEM OF LEGAL RELATIONS AND DOPING: PRACTICAL CONSEQUENCES FOR PROFESSIONAL FOOTBALL, organised by Fundacion del Futbol Profesional on the 12th of June 2013

Fundacion del Futbol Profesional held its second legal breakfast on the 12th of June at the LFP’s headquarters during which two topical issues for Spanish professional football were analysed: the labour legislation reform and the new bill on doping.

The meeting, presented by LFP’s chairman Javier Tebas Medrano, had the participation of Antonio V. Sempere Navarro, professor of labour law, and Alberto Palomar Olmeda, tenured lecturer (ANECA accredited) of administrative law. It was chaired by Miguel M. García Caba, LFP’s legal advisor.

This legal breakfast was attended by many clubs and SADs from the LFP, as well as representatives from legal firms and public administrations. During the breakfast, the legal consequences that the recent labour reform included in the statute of workers by Act 3/2012 on urgent measures for the labour reform, dated 6th of July, has on the labour relations of professional footballers was analysed, as well as the main legal consequences for the members of the LFP of the Bill on Sportspeople health and the fight against doping in sports.

The working breakfast had the approach of an open dialogue between speakers and attendees with the aim to combine several perspectives, to try to reach a correct diagnosis on the current problems and to identify real solutions for the near future.

The Insolvency of Sport Entities

This publication was the result of the work of a research team created at the University San Pablo CEU with the support of the Spanish Association of Insolvency Law and headed by Emilio Beltran and Alberto Palomar. The team was also made up of senior judge Enrique Sanjuan, lecturer Ana B. Campuzano, expert lawyers Yolanda Morales, Juan Carlos Rodríguez Maseda and Javier Tebas and economists Marcelo Pascual and Pablo Vega.

Good sports governance: An exercise of social responsibility?

Author Miguel García Caba looks into the application of good sports governance in the everyday management of sport entities, thus filling an existing doctrinal gap. From a theoretical and practical point of view, a whole set of mechanisms and good governance practices that could lead to the better organisation of sport entities that aim to be socially responsible is suggested.

The author believes that “good sports governance” must be seen as a responsibility by sporting entities before their members, the sport itself and, especially, before society.
